Die Bundesregierung ist neben dem Bundespräsidenten eines der obersten Organe der Bundesverwaltung (sog. Kollegialorgan). Die Mitglieder der Bundesregierung sind der Bundeskanzler, der Vizekanzler sowie die übrigen Bundesminister.
Der Bundeskanzler ist Leiter des Bundeskanzleramtes und Vorsitzender der Bundesregierung, als deren primus inter pares (lat. Erster unter Gleichen) er Vorschläge für die Ernennung bzw. Entlassung der übrigen Bundesminister machen, jedoch den Bundesministern keine Weisungen erteilen kann.
Wie der Bundeskanzler sind auch die Bundesminister oberste Organe der Bundesverwaltung (sog. monokratische Organe). Als solche sind sie selbst weisungsfrei und untergeordneten Behörden gegenüber weisungsbefugt. Zur Unterstützung in den Amtsgeschäften können den Bundesministern Staatssekretäre beigegeben werden, die als Hilfsorgane des jeweiligen Bundesministers fungieren und damit ihm gegenüber weisungsgebunden sind.
